Welcome to Sharehub’s Terms and Conditions. We’re happy you’re here to get familiar with the important bits. Please be sure to read these terms and conditions carefully as they contain clauses that affect your rights, remedies, and obligations. By using our services, you are agreeing to these terms and conditions, so it’s important to check you understand and feel comfortable with them. We’ve tried to be as clear as possible, but please let us know if there’s anything you don’t understand. You can check out our other policies on our website using links within this document.
“Sharehub”, “we”, or “us” and “our”:
means New Zealand Company Sharehub Limited (9251097).
“Owner(s)” means people or companies who own the items listed for rent using the Services and who may choose to enter a contractual relationship with a Renter for a booking and Rental.
“Renter(s)” means people or companies who rent things using the Services and choose to enter a contractual relationship with an Owner.
“Rent” / “Renting” / “Rental” means the contractual agreement for booking and hire of the Items
between the Owner and Renter for hire of Items for an agreed period at an agreed price.“Item(s)” means the goods, products, equipment, and all other things posted by an Owner for hire by a Renter on the Services.
“Services” means the Sharehub website(s), mobile applications, and associated which provide an online venue for people to get connected with each other, and the things they need.
“Platform” means the Sharehub website(s) and mobile applications.
“User(s)” means people interacting with the Services, regardless of whether they are also Renters or Owners or Registered Users.
“Registered user(s)” Means Users who have registered an account with Sharehub.
“Sharehub account” Means the account on the Sharehub Platform which is associated with a particular Registered User.
“Terms” means these Terms and Conditions as updated from time to time, together with Sharehub’s other Policies.
“The Agreement” means your legally binding agreement with us governed by the Terms.
“Website” means www.sharehub.co.nz.
“App” means the Sharehub mobile application which gives access to the Services.
“Policies” means all Sharehub’s Policies published on the Platform, and as updated from time to time.
“List” or “Listing” means publishing an Item on the Services make it available for booking and rental
“Book” or “Booking” means the agreement between an Owner and a Renter for the future Rental of an Item via the Services for an agreed period and price.
Words in the singular include the plural.
References to people includes Companies.
Headings do not form part of the terms and conditions. They are provided only to make these Terms easier to read and understand.
The fact that we wrote these Terms won't affect their interpretation.
Sharehub offers an online peer-to-peer rental platform that connects users looking to rent or share items. Our goal is to provide a safe and enjoyable experience for all users. To support this, we respond to complaints promptly and display reviews and star ratings, allowing users to make informed decisions when renting from one another.
Sharehub does not own any of the Items listed on our Services, and we do not offer them for Rent ourselves. This means we are not participating in the Rental transaction or the agreement between Renters and Owners; we just provide a Platform for users to connect, make payments, and arrange rentals.
We do not act as an agent for Renters, Owners or any Users.
We do not provide rental services.
Although we ask Owners to comply with our eligibility criteria and Policies, we make no assurances about the quality, suitability, or safety of the Items listed by Owners on our Platform. All decisions to Rent an Item from an Owner are entirely at a user’s discretion.
Although we ask Renters to comply with our eligibility criteria and Policies, we make no assurances about the qualities or abilities of the Renter as a suitable person to rent Items to. All decisions to Rent to another User are entirely at an Owner’s discretion.
In our sole and absolute discretion, we can permit or prohibit your use of the Services and your request to List, Book or Rent an Item. We may, but do not commit to, undertake efforts to ensure the safety of Items/Users. We neither confirm, nor endorse nor make any representations about the safety, roadworthiness, suitability, qualification or legal status of any Item/User.
If you choose to List or Rent something on our platform, you do so entirely at your own risk. If you are an Owner, you should have insurance. If you are a Renter, you may also be liable for damage that you cause.
When you use our Services, you are forming a contractual relationship with the Owner or Renter, and not with Sharehub. You acknowledge that there is inherent risk, which you are prepared to accept.
If you are a Renter or Owner, Sharehub will not be responsible to you for any items that you hire or lend through the Sharehub Service, including in relation to any loss, damage, theft, injury, or any incident whatsoever (unless paying for a warranty or guarantee).
The Owner (and not us) is responsible for ensuring that items conform to any descriptions provided, are fit for purpose, and safe to use.
If you are an Owner, you are entirely responsible for complying with any obligations you may have under applicable law with respect to the items that you provide for Rent,including giving effect to Renters' rights under applicable consumer law and compensating for any damage caused by your items.
If you are a Renter, you are entirely responsible for the proper care and return of any items you hire through the Sharehub Service. You may be liable for compensating the Owner for late returns, loss or damage to those Items including loss or damage resulting from your negligence, carelessness, improper use, lack of appropriate skills or experience, or theft. You may also be responsible for any damage or loss or injury you cause to other people or property when using the Item(s).
You agree to indemnify us and hold us harmless against any claim made by yourself or any third party that is in any way related to:
Your indemnity under this clause covers all losses, damages or expenses (including legal costs) that we may suffer or incur.
To the maximum extent permitted by law, you assume full responsibility for any loss or damage that results from your use of the Platform and Services. We won't be liable to you or any other person in connection with the Services, this Website, your use of the Services or Platform, or another User’s acts or omissions, whether for negligence, breach of contract, breach of statutory duty or otherwise. We won't be liable for anything that is outside of our reasonable control. We won't be liable for any loss or damage, whether direct or indirect (unless specified by our insurance policy). For example, we won't be liable for loss of profits, loss of business or anticipated savings, general or special damages, or consequential or incidental loss.
By accessing the Website and App, including by communicating with us or with other users, you are agreeing to comply with and be legally bound by the provisions of these Terms.
These Terms together with the policies govern your access to and use of the Services and constitute a binding legal agreement between you and Sharehub.
You agree that you will always use your Sharehub account and the services in compliance with these terms, applicable law, and any other policies and standards provided to you by Sharehub.
We reserve the right, at our sole discretion, to modify the Services or to modify the Agreement, including these Terms, at any time.
If we modify these Terms, we will post the modification on our website.
We will also update the “Last Revised” date at the top of these Terms.
By accessing our Services after we have posted a modification to these Terms, you are indicating that you agree to be bound by these Terms, as modified.
If the modified terms are not acceptable to you, your sole recourse is to stop using and accessing the Services and to close your Sharehub Account within 30 days.
If you choose to close your Sharehub Account, the previous effective version of these Terms will apply to you, unless you use the Services during the intervening 30-day period, in which case the new version of these Terms will apply to you.
The Services are intended solely for Renters who meet our eligibility requirements in the location where the Item is booked, and Owners who are 18 or older. If you are under 18, you must obtain a parent or legal guardians’ permission to register.
By using our Services, you are confirming that you meet our eligibility requirements. You acknowledge that use of our services without meeting our eligibility requirements is expressly prohibited.
Sharehub is for New Zealand only. You must be located in New Zealand to list Items as an Owner or Rent items as a Renter, unless we specifically approve you to use Sharehub from another country.
To access certain features of the Services, you must sign up for a Sharehub Account.
All Owners and Renters must have a Sharehub Account.
In order to create a Sharehub Account you must meet our eligibility requirements and provide your first and last legal name, your email address, your mobile phone number, and create a password or connect through an account with a third-party site or service.
When you list an Item as an Owner, you may be required to provide us with certain additional information about yourself and the Item.
You must provide accurate, current, and complete information during the registration, Booking, and/or Rental process.
You must keep the details on your Sharehub Account accurate and up to date at all times.
If you are an Owner, you must comply with our policies that require Owners to ensure their Items are legal, in safe and operable condition, legally registered (where applicable), not subject to any applicable safety recalls, and otherwise comply with NZ law.
Based on information you provide, Sharehub may impose additional requirements for you to book a Rental (e.g., providing a deposit, adding a second form of payment, buying a certain level of protection plan, or other requirements Sharehub may deem appropriate in our sole discretion).
We strive to make our platform safe for all users. Where permitted by law, Sharehub has the right, but not the obligation, to undertake screenings, checks, and engage in processes designed to help verify the identities or check the backgrounds of Users, including their driver’s license validity and verify Item details. Sharehub does not endorse any Item or User of our Platform or commit to undertake any specific screening process.
Sharehub may in its sole discretion use third-party services to verify the information you provide to us and to obtain additional related information and corrections where applicable, and you hereby authorise Sharehub to request, receive, use, and store such information in accordance with our Privacy Policy .
The fees we charge for using the Services and other cost structures will be itemised at checkout at the time of a Booking. You can verify the amount for your Rental at checkout before you submit your request.
When you provide Sharehub a payment method, you authorise Sharehub, or third-party service providers acting on behalf of Sharehub, to store your payment credential for future use in the event you owe Sharehub or owners any money. You authorise Sharehub to use stored payment credentials for balances, including for late fees, security deposits, processing fees and claims costs, and related administrative fees in accordance with our Privacy Policy . In some cases, our payment processors have arrangements with card networks to automatically update stored payment credentials whenever you receive a new card (e.g., replacing an expired card or one that was reported lost or stolen) and we will rely on such updates to stored payment credentials for balances.
Sharehub and its service providers may employ all legal methods available to collect amounts owed by you to Sharehub, including the engagement of collection agencies or legal counsel. Sharehub, or the collection agencies we retain, may also report information about your Sharehub Account to credit bureaus. As a result, late payments, missed payments, or other defaults on your Sharehub Account may be reflected in your credit report.
In addition to the amount due, overdue accounts or chargebacks will be charged with fees and/or charges that are incidental to the collection of overdue accounts or chargebacks including, but not limited to, collection fees, convenience fees, and/or other third-party charges. If you wish to dispute the information Sharehub reported to a credit bureau, please contact support@sharehub.co.nz . If you wish to dispute the information a collection agency reported to a credit bureau regarding your Sharehub Account, you must contact the collection agency directly.
Collecting and paying taxes will be your sole responsibility.
Sharehub will not enable the collection and remittance of certain taxes from or on behalf of Renters or Owners based on existing and future tax regulations unless specifically required by law.
You are, and will be solely responsible for, all activity that occurs through your Sharehub Account. Keep your Sharehub Account information, including your password, secure. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Sharehub Account, whether you have authorised such activities or actions. You will immediately notify Sharehub of any actual or suspected unauthorised use of your Sharehub Account. We are not responsible for your failure to comply with this clause, or for any delay in shutting down or protecting your Sharehub Account unless you have reported unauthorised access to us.
Subject to your compliance with the provisions of these Terms, Sharehub grants you a limited, revocable, non-exclusive, non-transferable license, to access and view any Sharehub and/or user content to which you are permitted access, solely for your personal and non-commercial purposes.
You have no right to sublicense the license rights granted in this section. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Sharehub or its licensors, except for the licenses and rights expressly granted in these Terms.
We may, in our sole discretion, permit you to post, upload, publish, submit or transmit content through the Services such as photographs of you and Item(s), reviews, feedback, and descriptions of you, item, or Rental experience.
By making available any content on or through the Services, or through Sharehub promotional campaigns, you grant Sharehub a worldwide, irrevocable, perpetual (or for the term of the protection), non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, view, copy, adapt, modify, distribute, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such content on, though, by means of, or to promote or market the Services.
Sharehub does not claim any ownership rights in any such content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit any such content.
We respond to notices of alleged copyright infringement and terminate the Sharehub Accounts of repeat infringers. If you think a User is violating your copyright, and want to notify us, you can find information about submitting notices at support@sharehub.co.nz .
Some areas of the Services implement Google Maps/Places mapping services, including Google Places API. In addition, to fight spam and abuse of the Services, Sharehub may implement reCAPTCHA Enterprise, a Google service. By using the Services, you are bound by Google's Terms of Service.
In connection with your use of or access to the Services, you agree that you will not, nor will you advocate, encourage, request, or assist any third party to:
● Breach, violate, and/or circumvent any law or regulation, or any order of a Court, including, without limitation, tax regulations, licensing or registration requirements, or third-party rights
● Post false, inaccurate, misleading, defamatory, or libelous content
● Infringe, reproduce, perform, display, distribute, reverse engineer, or prepare derivative works from content that belongs to or is licensed to Sharehub, or that comes from the Services and belongs to another Sharehub User or to a third party, including works covered by any copyrights, trade mark, patent, or other intellectual property, privacy, publicity, moral, or contractual rights, except with prior express written permission of Sharehub.
● Through unauthorised use of the Services and/or user content
● Registering and/or using "Sharehub" or derivative terms in domain names, trade names, trademarks, or otherwise
● Registering and/or using domain names, trade names, trademarks, social media account names, or other means of identification that closely imitate or are confusingly similar to Sharehub domains, trademarks, taglines, promotional campaigns, or Sharehub and/or user content
● False name, date of birth, driver’s license details, payment method, insurance, or other personal information
● In relation to an Item listed (for example hiding damage to an Item)
● By registering for a Sharehub Account on behalf of an individual other than yourself or the company you represent
● Impersonating any person or entity, or falsifying or otherwise misrepresenting yourself or your affiliation with any person or entity
● Fail to pay fees, penalties, or other amounts owed to Sharehub or another User
● Fail, as either a Renter or Owner, to timely deliver, make available, timely collect, or timely return any Item, unless you have a valid reason. If you have a valid reason, please contact the other party to discuss ASAP
● Use the Services to find an Owner or Renter, and then complete a transaction partially or wholly independent of the Services, for any reason including but not limited to circumventing the obligation to pay any fees related to the provision of the Services by Sharehub
● Transfer your Sharehub Account and/or user ID to another party without our consent
● Leave an Item unlocked or unsecured except where instructed to do so directly by Sharehub or the Owner in certain limited circumstances
● Harass, stalk, or defame any other Sharehub User or collect or store any personally identifiable information about any other user other than for purposes of transacting as an Owner or Renter in accordance with these Terms
● Engage in physically or verbally abusive or threatening conduct
● Use the Services to transmit, distribute, post, or submit any information concerning any other person or entity, including without limitation, photographs of others without their permission, personal contact information, payment method details, or account numbers
● Treat anyone differently based on the way they look, who they love, what they believe, how they self-identify, where they are from, or when they were born. Discrimination of any kind is not tolerated in the Sharehub community
● Sue or assert legal claims against Sharehub or a Sharehub user in any manner prohibited or waived by these Terms
● Contact another Sharehub User for any purpose other than in relation to a booking or listing, or the use of the Services by such User
● Commercialise any content found on the Services or software associated with the Services, including reviews
● Harvest or otherwise collect information about users without their and our consent
● Recruit or otherwise solicit any user to join third-party services or websites, without our prior written approval
● Interfering with any other User’s listings
● Using the Services in connection with the distribution or posting of unsolicited messages (e.g., spam)
● Distributing viruses or any other technologies such as cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, backdoors, packet or IP spoofing, forged routing or e-mail address information, or similar methods or technology that may disrupt or interfere with the operation or provision of the Services, or harm Sharehub or the interests or property of others
● Bypassing robot exclusion headers, interfering with the working of the Services, or imposing an unreasonable or disproportionately large load on our infrastructure
● Systematically retrieving data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, directory, or the like, whether by manual methods, or through the use of bots, crawlers, spiders, or otherwise
● Using, displaying, mirroring, or framing the Services or any individual element within the Services, the Sharehub name, any Sharehub trademark, logo, or other proprietary information, or the layout and design of any page or form contained on a page in the Services, without the express written consent of Sharehub
● Accessing, tampering with, or using non-public areas of the Services, our computer systems, or the technical delivery systems of our service providers
● Attempting to probe, scan, or test the vulnerability of any of our system or network or breach any security or authentication measures
● Avoiding, bypassing, removing, deactivating, impairing, descrambling, or otherwise circumventing any technological measure implemented by Sharehub or any of our service providers or any other third party (including another user) to protect the Services
● Forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way using the Services to send altered, deceptive, or false source-identifying information
● Attempting to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Services
● Endeavouring to circumvent a suspension, termination, or closure of your Sharehub Account or the account of another Sharehub user, including, but not limited to, creating a new Sharehub Account or listing Items affiliated with or registered to a Sharehub Account holder that has been suspended, terminated, or closed
Sharehub has the right, but not the obligation, to investigate, pursue, and seek to prosecute, litigate, or refer to law enforcement, violations of the agreement to the fullest extent permissible by the law.
Sharehub reserves the right, at any time and without prior notice, in accordance with applicable law, to remove or disable access to any content that Sharehub, at its sole discretion, considers to be objectionable for any reason, in violation of these Terms, or otherwise harmful to the Services or our community. If we believe you are abusing Sharehub, our users, or any other person in any way or violating the letter or spirit of any of these Terms, we may, in our sole discretion and without limiting other remedies, limit, suspend, or terminate your Sharehub Account and access to the Services, remove hosted content, deny a damage claim, remove or demote your listings, reduce or eliminate any discounts, and take technical and/or legal steps to prevent you from using the Services. Additionally, we reserve the right to refuse or terminate access to the Services to anyone for any reason at our discretion to the full extent permitted under applicable law.
When an issue arises, we may consider the user’s performance history and the specific circumstances in applying our policies at our sole and absolute discretion.
You agree that Sharehub may contact you by electronic means (e.g., electronic mail; notifications via Sharehub messaging; app notification) in lieu of any requirement for mailed notices. To contact you more efficiently, you agree that we may at times also contact you using autodialled or prerecorded message calls or text messages at your phone number(s). We may place such calls or texts to confirm your signup, provide notices regarding your Sharehub Account or Sharehub Account activity, investigate or prevent fraud, collect a debt owed to us or recover unpaid invoices, or communicate urgent messages. We may share your phone number(s) with service providers with whom we contract (such as insurance providers) to assist us in pursuing these interests. We will not share your phone number(s) with third parties for their own purposes without your consent. Standard telephone minute and text and data charges may apply. Where Sharehub is required to obtain your consent for such communications, you may choose to revoke your consent. You agree that Sharehub may contact you on any day, at any time of day, and in relation with the above purposes.
In accordance with New Zealand Law and Sharehub’s privacy policy you authorise Sharehub and our service providers, without further notice, to monitor or record web chat interactions you have, or anyone acting on your behalf has, with Sharehub or its agents for quality control, training, or other purposes. You understand and agree that your communications with Sharehub may be overheard, monitored, or recorded. If you do not wish to have your call recorded, please advise us at the time of the call. If you do not wish to have your chat activity recorded or monitored, please do not use the chat function on the Services. Please note that this will not be done as a general rule but will generally only be undertaken if we believe the user is breaking a law or seriously violating these terms, or if required for insurance purposes.
Sharehub is not an insurance company and does not insure Owners or Renters. Owner and Renter protection plans made available through the Services are in no way related. To be eligible for the benefits of a protection plan, Owners and Renters must comply with these Terms. Protection plans are available through the Services only in New Zealand. Please refer to the Specific terms for Renters and Owners sections below for additional information based on the nature of your use of the Services.
Our payment processing services are provided by Stripe and subject to the Stripe Connected Account Agreement , which includes the Stripe Services Agreement (collectively, the "Stripe Terms"). You agree to be bound by the Stripe Terms, which may be modified from time to time. You also agree that Sharehub is not liable in cases where Stripe processes a payment late or makes a mistake relating to a payment or a payment hold. As a condition of Sharehub enabling payment processing services through Stripe, you authorise Sharehub to obtain all necessary access and perform all necessary activity on your Stripe Connected Account to facilitate sharing of your Item.
Owners must provide accurate, complete, and updated information to Sharehub and Stripe, and acknowledge that Sharehub and Stripe are unrelated entities. Users are responsible for separately updating Sharehub and Stripe when there are material changes to the information previously provided (e.g., business name, tax information, contact information). You authorise Sharehub to share such information and transaction information with Stripe for the purposes of facilitating the payment processing services provided by Stripe. Sharehub reserves the right to switch payment processing vendors at its discretion.
We work hard to ensure the security and performance of our Services, but we don't guarantee that our Services will be 100% secure, uninterrupted or error-free. We provide our Services on an 'as is' basis, without any warranty of any kind. That means your use of our Services is at your own risk. It also means that we exclude and disclaim all implied warranties, to the extent that we legally can, such as fitness for purpose, merchantability and non-infringement.
If you are using our Services for a personal purpose, then nothing in our Terms limits any consumers' legal rights that may not be waived or limited by contract.
Any information or advice that we may give you regarding or during your use of our Services is also subject to the disclaimers in these Terms and won't create any warranty that isn't expressly given in these Terms.
We aim to ensure that Sharehub offers items that meet the demand of renters. To maintain this, we may limit the number of items listed or suspend owners at our discretion. For instance, owners whose items are rarely or never booked may have their items removed from time to time. We will also routinely monitor the platform for any illegal activity and may pause or delete accounts that we believe violate New Zealand laws.
The following sections also apply if you book an Item for rent using the services:
As a Renter, you commit that:
● You comply with our eligibility criteria
● You will treat the Item well and will take all reasonable measures to return the Item on time and in essentially the same condition as received.
● You will not allow anyone other than a person listed in the booking details to use the Item you booked. If you do, you acknowledge that you are solely responsible for the item.
● You will return the Item at the date and time agreed or accept that late fees may apply.
● The renter acknowledges and accepts that they are fully liable for costs if they damage an item or fail to return it for any reason. Costs may be automatically withdrawn or held if a claim is made against them until the issue is resolved.
When you book an Item on the Services, you must use the Item only for your personal use and not for any commercial purposes unless you have express written permission from the Owner in advance. You may not access an Item until the booking time, and you must return the Item on time and to the correct location.
You must exercise reasonable care in your use of the Item. You are always required to use/operate the Item safely, and in compliance with all applicable laws.
In the event Sharehub has any concern about your use of an Item, Sharehub may terminate your rental at its discretion at any time and require the return of the Item, including recovering the Item on behalf of the Owner.
If you have any concerns about your planned use, please contact support@sharehub.co.nz . If you misuse an Item, you may be fully financially responsible for any related claims, loss, or damage if the Owner’s insurance policy is voided by your misuse.
You understand that third party Owners (not Sharehub) own the Items offered through the Services. Each Owner is responsible for complying with all legal requirements (including ensuring the Item is registered and insured where applicable) and maintaining their Item(s) in safe condition.
Please complete a visual inspection before you begin your use of the Item. If you find damage in your initial inspection, you should upload photos of such pre-existing damage at the start of your reservation to ensure you are not held responsible for pre-existing damage.
You acknowledge that Sharehub is not responsible and shall not be liable for the safety, or legal status of any Items shared via the Services beyond our policies. You also acknowledge and agree that neither Sharehub nor Owners are responsible for lost or stolen property left in or with any Item or taken or damaged during your Use of the item.
You must immediately report any damage to the Item you are using to Sharehub at support@sharehub.co.nz . You must complete an incident report in all cases with a written description of the incident and any other information requested, including identity and insurance information of any parties involved in the incident. You are also required to cooperate in any loss investigation conducted by Sharehub, third party claims administrators, or insurers. After an incident involving anything more than minor Item damage (e.g. scratch), you may not continue to use the Item unless you have the explicit permission of Sharehub staff. Failure to timely report an incident or cooperate in an investigation may reduce or invalidate any insurance protection, in which case you will be personally liable for the damage or loss.
You agree that the following conduct may result in the reporting of the Item you have booked as stolen to the Police:
● If you do not return the Item by the end of the reservation period and you have not properly obtained an extension of the reservation through the Services
● If the Item is returned to any place other than the return location on the reservation or agreed upon with the Owner
● If you misrepresent facts to the Owner pertaining to booking, use, or operation of Item
● If you fail or refuse to communicate in good faith with the Owner, police, Sharehub, or other authorities with a full report of any accident or vandalism involving the Item or otherwise fail to cooperate in the investigation of any accident or vandalism
● If the Item is operated by anyone who has given a fictitious name, false address, or a false or invalid identity document, or who misrepresents or withholds facts to/from the Owner or Sharehub material to the booking, use, or operation of Item
The following sections also apply if you share your Item through the Services:
As an Owner, you commit that:
● Your Item complies with our policies
● You will provide such Item on, for the duration of the rental period
● Other than what is required for you to verify a Renter’s identity, you will not collect any information or documentation from your Renter at check-in
● Your listings will be complete and accurate, and you will honour all representations made in your listings, including honouring the price quoted to a Renter. You will not cancel a booking for the purpose of seeking a higher price from a Renter. You will not offer an Item that is not safe and legal in the location where it is shared, and it will not have any illegal modifications to any part of the Item.
● You will comply with the provisions of the Consumer Guarantees Act, the Fair-Trading Act, and all other relevant legislation.
● You are responsible for ensuring the Item is in the stated condition and available for pick up at the agreed time.
Item information given at listing;
When you sign up for Sharehub, you will identify Item(s) that you want to list for Rent through the Services. Each Item must meet the requirements it was originally intended to perform. You may only use the Services in connection with Items that you own or otherwise have all the necessary rights and permissions to share for compensation. If the Item you list on the Services is enabled with a device or OEM technology capable of determining the location of the Item, disabling technology, or image or audio capturing you agree to comply with applicable law, and to disclose it to Renters in the Item description.
Once an Item is booked, you must make the Item available or deliver the Item as expected by the Renter. If you offer the Renter the option to pick up your Item at a specified location, you must supply the location of the Item accurately to Sharehub and ensure that the item is available at that location at the beginning of the reservation period.
You will have the ability to set and revise the Item’s pricing as you choose. Sharehub will pay you the amount collected from Renters that book your Item, less the applicable fees payable to Sharehub. A description of fees can be found here. To the extent you owe Sharehub or any third-party money for any reason, Sharehub also reserves the right to deduct those amounts from your earnings payment, debit your bank account, charge any of your payment methods on file, and/or send you an invoice.
Prior to each rental term, you are required to regularly check your Items for any defects in operations and safety. You promise that, at all times, your Item will be in safe and suitable condition, and in full compliance with all applicable inspection and registration requirements, including any required safety inspections, or test and tag requirements.
You agree to respond to any applicable recall or similar safety notices and to complete any recommended action before allowing your Item to be booked.
In addition, if Sharehub believes that your Item does not conform to reasonable standards, Sharehub may notify you and reserves the right to remove or decline listing your listing until its concerns have been resolved. Sharehub may, but does not commit to, undertake efforts to ensure the safety of Items booked through the Services.
If you believe that a Renter has caused any damage to your Item, you are required to report that damage as soon as you become aware of it (and in any event, no more than 24 hours after the scheduled end of the booking) and to provide reasonable cooperation in the investigation of the damage so that it can be eligible for coverage.
Based on the investigation, Sharehub or third-party claims administrators will reasonably determine whether the damage occurred during the reservation period and is eligible for coverage. If it was, and you did not decline a protection plan made available via the Services, you will be reimbursed for the loss as described in the sections below.
If Sharehub is not given prompt notice as described in this paragraph, or if you do not provide reasonable cooperation in the investigation by Sharehub or third-party claims administrators, your coverage may be declined.
You must use our Services for their intended purpose and must not misuse them in order to avoid our fees, advertise your business or manipulate search results.
In order to keep costs to a minimum, the most cost-efficient option is to check if your item is covered under your own insurance policy (home and contents, commercial insurance etc). If you have existing home and contents, commercial, or home insurance, it should be utilised before applying for additional coverage through Sharehub or our insurance providers. Should your existing insurance not cover the item, you should then consider Sharehub's Owner’s Guarantee.
Owner’s insurance cover will be entirely in accordance with their Insurance Policy terms and conditions and is the Owner’s responsibility.
We're dedicated to maintaining a safe environment within the Sharehub community for renting your items. According to our Terms of Service, renters who fail to return or damage an item are responsible for the full replacement or repair cost, irrespective of the circumstances. However, if a renter proves uncooperative, rest assured, we've got you covered. When you list your items on Sharehub we offer multiple options to cover your item if it is damaged or stolen so you can choose the one that works best for you. Additionally, our customer support team is always available to provide immediate assistance if needed.
Coverage: Your items are covered up to the amount specified on your proof of purchase and the item value you provided during the listing process. Sharehub reserves the right to decide whether to reimburse the original purchase value, cover the replacement cost, or provide a replacement item, always aiming to meet your needs.
Exclusions Apply: Certain items are not covered under Sharehub’s Owner Guarantee, including real estate, vehicles, pleasure craft, consumables, weapons, wear and tear, lack of maintenance, software, internal components, and public liability.
To qualify for coverage, you must affirm the following statements truthfully:
I am the verified account holder on Sharehub who owns the item.
I have submitted all required documentation for the claim.
If you are in doubt or have any questions relating to the insurance criteria, please email us details of your personal circumstances to be reviewed by our insurance broker and/or Underwriter for their decision prior to confirmation of cover.
Here's what you need to know before and after renting out your items:
First things first, snap some photos or a video of your item within 24 hours before it's picked up for rent. Make sure these are time-stamped, so either use your smartphone or our app for easy timestamping. Ensure a photo is taken of any serial numbers on the item.
If your item has a core function, like a drone flying or a mixer mixing, capture that on video. This way, if something goes wrong during the rental period, you have proof that it was working fine before renting it out.
And speaking of damage, if you suspect your item has been damaged during the rental, document it with photos or videos within 24 hours of its return and prior to renting it out again.
If the item doesn't come back on time or it's damaged, don't wait around. Open a case with us within 24 hours of the rental's end date through contact us page or email us at support@sharehub.co.nz
with the following information.● Your Name
● Your email address (as per your Sharehub account)
● Name of the person who rented your item
● Item related to the claim
● Date of incident
● Photos (including serial numbers and damage)
● Description of what happened
Following this, Sharehub (or our insurance partner) will contact you to discuss the next steps.
Remember, list all the items you're lending out. If it's not on the listing, it's not covered.
Keep your proof of purchase and serial numbers handy. They are crucial for successful claims.
We believe in resolving issues directly whenever possible. So, try to sort things out with the borrower first. If that doesn't work, our dedicated Resolutions Team is here to help mediate.

Step 1- Check if your home and contents insurance, car or home insurance covers rental of your specific items.
If yes, no problem, you’re covered and probably don’t need additional coverage.
Step 2 - If your item is valued below $500 – Sharehub’s inhouse Owner Guarantee can cover your items provided it is selected at the time of listing. This will cover items valued up to $500. This option includes an additional 5% fee on all transactions, covering claim management and enhanced protection. Please note that an excess on any claim may apply.
Step 3 - If your item is valued over $500 and is not covered by your own insurance, or by Sharehub’s Owner Guarantee, click this link and we will connect you with our dedicated insurance provider to provide options for cover.
Cover can be arranged on a case-by-case basis for household contents items, specialist gear/equipment, registered motorised vehicles, trailers and pleasure craft in accordance with Affiliated Insurance Brokers Terms and Conditions .
If Sharehub, or third-party claims administrators, choose to pay you the actual cash value for your Item, you will be required to do one of the following at the sole discretion of Sharehub as a condition for receiving payment: (1) transfer title to the Item or Item, and, if requested, physically deliver the Item to Sharehub or a third party appointed by Sharehub to accept title and physical delivery (if applicable); or (2) retain title to the Item and accept a reduction of the actual cash value equal to the salvage value of the damaged Item based on the highest third-party salvage quote that Sharehub obtains for the Item. The standard for determining the actual cash value will be as determined by Sharehub or its third-party claims administrators and in compliance with applicable law.
Protection plans selected by Owners on the Services do not apply to normal wear and tear to your Item
If you violate the Agreement, these Terms, or any of our Policies or if you submit inaccurate information about your Item when listing it on the Services (for example, falsely represent the condition, brand, model, or year of the Item), any protection plan you selected will be voided. A protection will be voided under this provision even if the underlying circumstances are not directly related to the damage or harm at issue. You acknowledge that these provisions are material and that they serve to ensure your compliance. In the event your protection plan is voided, the remainder of the Agreement, these Terms, and Policies remain in effect.
If you selected a protection plan via the Services and your Item goes missing, is not returned, and/or is stolen during the reservation period (or extension period), you, as the host, must immediately contact a Sharehub representative and follow his or her instructions, including cooperating with Sharehub, the police, and any other authorities related to the investigation of the theft. If you are instructed by Sharehub to file a police report, you must do so promptly after receiving those instructions.
You agree to try to resolve any disputes you have with other Users directly with them.
We do try to offer help and information where we can, but please keep in mind that we're not a party in any transaction between you and another User, and there's only so much we can do.
Because we care about our user’s privacy, if you're taking a dispute with another Registered User to the Disputes Tribunal or other tribunal or committee, we'll only release that Member's details if you sign a statutory declaration.
If you have a dispute with us, please get in touch and we'll try to resolve it informally. If we need to contact you about a dispute, we'll use the last email address you gave us or any other reasonable method. If we haven't been able to resolve a dispute informally, either party can look to resolve a dispute or seek any remedy available through any legal method available.
The Commerce Commission is responsible for enforcing a number of consumer laws, including the Fair-Trading Act (which prohibits false and misleading behaviour). If you have a complaint about Sharehub being misleading, you can refer it to the Commission.
The Advertising Standards Authority is a self-regulating body for the advertising industry, dedicated to ensuring advertising is socially responsible, truthful, and not misleading. If you have concerns about any Sharehub advertising, you can submit these to the ASA.
These Terms are governed by the laws of New Zealand. If there's a dispute, it will be resolved in New Zealand.
You may discontinue your use of the Services at any time and Sharehub may terminate your access to the Services and remove any listings for any reason or no reason to the extent permissible under applicable law. Termination of access to the Services will not release a Party from any obligations it incurred prior to the termination and Sharehub may retain and continue to use any information, including but not limited to photography, previously provided by you. Termination of the Agreement will not have any effect on the disclaimers, waiver or liability limitations, or legal disputes provisions under the Agreement and/or any fees due, and all of those terms will survive any termination of the Agreement.
Except as otherwise provided herein, Renters and Owners agree that nothing in these Terms constitutes an actual or purported transfer or assignment of any right or interest in an Item shared through the Services.
Sharehub provides services that enable the sharing of items between owners and renters. Except as otherwise provided in these terms, Sharehub does not itself provide item sharing, rental services, and/or insurance services and is not responsible for any of the acts or omissions of any of the users of its services, the manufacturer of the item, or any third-party provider of services.
The services are provided “as is,” without warranty of any kind, either express or implied. To the extent permitted by applicable law, without limiting the foregoing, Sharehub explicitly disclaims any warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement, and any warranties arising out of course of dealing or usage.Sharehub makes no warranty that the services, including, but not limited to, the listing and/or any item or optional extra, will meet your requirements or be available on an uninterrupted, secure, or error-free basis. Sharehub makes no warranty regarding the quality of any listings, items, owners, renters, extras, the services, or any content or the accuracy, timeliness, truthfulness, completeness, or reliability of any content obtained through the services. No advice or information, whether oral or written, obtained from Sharehub, Sharehub insurance agency, or its service providers or through the services or content, will create any warranty not expressly made herein.
Except where prohibited by law, you waive and discharge any and all rights you have to sue or make claims against Sharehub and any of its subsidiaries, directors, officers, agents (including third-party administrators, insurance producers, and insurance providers), or employees (together, the “Sharehub parties”) and any Sharehub user for any damages or losses, whether due to negligence or otherwise, arising out of or in connection with the following: (1) item availability (e.g., an item or item not being available or returned when it was supposed to be), (2) problems with a rental product (e.g., any malfunction of or deficiency with a rental product), (3) warranty issues (e.g., any breach of warranty or other obligation by any manufacturer or other third party associated with the item), (4) the legal or license status of an item, host, or renter, (5) third party assessments of an item's value, or (6) any action or inaction of an owner or renter.
You agree that neither Sharehub nor any other party involved in creating, producing, or delivering the services will be liable for any incidental, special, exemplary, or consequential damages (including lost profits, data, or goodwill, service interruption, computer damage or system failure, or the cost of substitute products or services), whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, arising out of or in connection with the following: (1) the agreement, (2) the services (including listing or booking of any item or optional extra via the services), or (3) inability to use the services.
Except for our obligations to pay amounts to applicable owners or renters pursuant to these terms, including an approved payment request or claim under a protection plan or applicable insurance policy, in no event will the Sharehub parties' aggregate liability arising out of or in connection with the agreement or your use of the services, exceed the greater of (1) the amounts you have paid or owe for bookings via the services as a renter in the twelve-month period prior to the event giving rise to the liability, or if you are an owner, the amount earned by you in the 12-month period prior to the event giving rise to the liability, or (2) NZD$100.
Except where prohibited by law, you also waive and discharge any and all rights you have to sue or make claims against any Sharehub user for any damages or losses arising out of or in connection with your use of the services.
The above limitations of liability and waiver provisions are fundamental elements of the basis of the bargain between Sharehub and you. They shall apply to the extent permitted by applicable law, and any aspects of them that are deemed void or unenforceable shall be severed while leaving the remainder in effect.
You agree to release, defend, indemnify, and hold Sharehub and its subsidiaries, officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (1) your access to or use of the Services, (2) your violation of these Terms, (3) your user content, (4) your interaction with any other user of the Services, or (5) your booking of an Item or creation of a listing for a Item. Such indemnification includes but is not limited to any injuries, losses, or damages (compensatory, direct, incidental, consequential, or otherwise) arising in connection with or as a result of a booking, sharing, or use of an Item. This indemnification provision is a fundamental element of the basis of the bargain between Sharehub and you. It shall apply to the extent permitted by law, and any aspects of it that are deemed unenforceable shall be severed while leaving the remainder in effect.
You acknowledge that the actual damages likely to result from your breaches of the Agreement by any of the following are difficult to estimate accurately and would be difficult for Sharehub to prove with certainty: (1) engaging in grey market transactions (2) using the Sharehub domains, trademarks, or taglines without Sharehub's express consent, including without limitation registering website domains or social media handles, or bidding on online advertising key words, (3) suing or asserting legal claims against the Sharehub Parties or a Sharehub user in any manner prohibited or waived herein, (4) as an Owner, sharing your Item via the Services in a state that is unsuitable for the intended use or different from what you advertised, (5) as an Owner, offering any Item that is the subject of a missing or stolen Item report, (6) as an Owner, offering any Item or releasing a Item to a Renter that is in an unsafe condition, (7) as an Owner, cancel or modify a booking to manipulate the price or potential earnings for an Item, or (8) creating or using a Sharehub account that has the effect of circumventing Sharehub’s suspension, termination, or closure of another Sharehub account. You will pay Sharehub $5,500 per breach in Liquidated Damages to compensate Sharehub for any such conduct. This amount is not intended as a punishment for any such breach, but rather as a reasonable estimate where actual damages are difficult estimate accurately and/or prove with certainty. These liquidated damages provision is a fundamental element of the basis of the bargain between Sharehub and you. It shall apply to the extent permitted by applicable law, and any aspects of it that are deemed unenforceable shall be severed while leaving the remainder in effect.
Sharehub is not a rental company. It does not own a fleet of Items or products and is not in the business of renting Items or products to the public. Sharehub also is not providing short- or long-term Item leases. Sharehub provides an online platform where item owners and those in need of various items/products can meet and share items/products/services amongst themselves subject to these Terms.
Sharehub may, in its sole discretion, round up or down amounts that are payable from or to Owners or Renters to the nearest whole functional base unit in which the currency is denominated unless explicitly prohibited under applicable law.

Where Sharehub has provided you with a translation of the English language version of these Terms or any Policies, in case of any wording discrepancies between the English and any other versions of the Terms and any Policies, the English language wording takes precedence.
In the event any provision of these Terms is held to be void, voidable, or unenforceable, the remaining provisions shall remain in full force and effect. The failure of any Party to enforce any provision of these Terms shall not be construed to be a waiver of such provision, or any other provision, nor in any way to affect the validity of these Terms or any part of these Terms, or any right of any Party to enforce that provision or each and every other provision at any time. No waiver of any breach of these Terms shall constitute or be deemed a waiver of any other breach.
Sharehub does not appoint you or any other user as its employee, mandatory, legal agent, or form any kind of legal partnership or joint venture. You are not authorised to make any commitments on behalf of Sharehub and Sharehub will not make commitments on your behalf, except as contemplated by the Services or expressly stated in these Terms.
The Agreement, including these Terms, states the entire understanding between you and Sharehub concerning your access to and use of the Services and supersedes any earlier verbal or written communications between us. With the exception of appointing a custodian to manage your Items on your behalf, you may not delegate your legal obligations or transfer any of your rights, in whole or in part, to any third party without advance written consent of Sharehub. You will remain responsible for your obligations hereunder in any event. A Sharehub director or officer must agree to any modification or waiver of any term of the Agreement in writing. Headings are for reference purposes only and do not limit the scope or extent of such section.
